Our client was offered a settlement agreement after the employer exacerbated his fear by violating his confidentiality. We refused this offer and, after a complaint, wrote a response on his behalf. We drew their attention to our objectives of a speedy resolution of the issue, which would save them a lot of time and costs, and we therefore presented a counter-proposal. This proposal included: full salary, payment of the bonus gap between the current year and next year, termination date, including leave expenses, 6 months` salary, contribution to legal fees and a reference. We have proposed a withdrawal agreement and the employer`s response is in the prejudiced letter. In addition to an increased workload, our client experienced bullying and negative comments on Facebook as well as in her supervisor`s office, which left her sick disconnected from stress. This letter without prejudice offers a relatively free payment of 6 months` salary and contractual benefits, such as termination indemnity. Transaction letters are legally binding and can be used in court for all disputes between the parties. The terms set out in a transaction letter are mutually agreed between the two parties. Both parties negotiate before the terms set out in the letter are concluded.
With the exception of the obligations set out in the contract of employment and in any other agreement between the employer and the worker and which, by their nature, continue to apply after the date of separation, this Agreement constitutes the entire agreement between the Parties and supersedes all prior agreements, understandings, guarantees, obligations and discussions between the Parties, whether written or orally. These are different models of transaction agreements (previously called compromise agreements) and you should have a lot to do with each other. In addition, the employee understands and agrees that the terms of the confidentiality agreement signed by the employee are always valid for any termination of the employee`s employment relationship with the employer, as set out in this regulation, and that the employee undertakes to comply fully with the terms of this confidentiality agreement. . . .
